The German-Vietnamese Rule of Law Dialogue
Germany is engaged in Rule of Law Dialogues and other justice-related exchanges with several different countries – often within the context of modernisation partnerships. The Rule of Law Dialogue with Vietnam is part of these activities. The goal of this initiative is to use an improved understanding of Vietnamese culture and traditions to help consolidate rule-of-law thinking and practice – which includes effective respect for human rights. Within the broad scope of this objective, the specific aim is to provide further support for the reform of Vietnam's justice and legal system.
Based on the Joint Declaration signed by the Foreign Ministers of Germany and Vietnam in February 2008, the Rule of Law Dialogue covers many important areas of public and private law with the goal of modernising the legal order and facilitating Vietnam's integration into the international legal environment. The declaration furthermore assigns the task of coordinating the Rule of Law Dialogue to the Justice Ministries of the two countries.
In April 2009, the German and Vietnamese Justice Ministries signed an initial three-year programme for the Rule of Law Dialogue (2009-2011) and issued a declaration regarding its coordination. This was followed by a second three-year programme lasting until 2014. In the process, we have created an organisational framework which identifies the main areas conducive to cooperation – such as the further development of the judicial system, civil law and civil procedure law, commercial law, criminal law and criminal procedure law, as well as the provision of support in implementing international conventions and regulations.
Over the past few years, numerous joint events have been organised in Germany and Vietnam by the Federal Ministry of Justice and Consumer Protection, the Federal Foreign Office, the Federal Ministry of the Interior, and the Justice Ministries of the Länder, in addition to political foundations and other organisers of law-related projects. Since 2010, the German Foundation for International Legal Cooperation (IRZ) has also been actively involved in the German-Vietnamese Rule of Law Dialogue on behalf of the Federal Ministry of Justice and Consumer Protection. Further expert meetings, internships, and seminars on implementing the three-year programme for the Rule of Law Dialogue are planned for 2014.
